Memorándum sobre Libia – Mentiras contra el Estado, el Guía y el ejército (II)

Saif Al Islam Gadafi (*)

Idénticamente, la acusación de que se usaron aviones de guerra Mirage de la base aérea de Al-Weathy, en el extremo oeste de Libia, para atacar a los civiles de Benghazi carece de toda lógica ya que su consumo de carburante impedía a esos aviones alcanzar esa ciudad y volver a esa base. Es en efecto imposible para ese tipo de aviones atacar blancos a 1 500 kilómetros de su base y volver sin reabastecerse y había alrededor de Benghazi bases aéreas que el gobierno libio hubiese podido utilizar de ser necesario. El Viagra supuestamente hallado en los tanques es una manipulación similar. Libia disponía de un ejército joven, profesional y moral, que no pensaba en cometer ese tipo de crímenes ni necesitaba Viagra para activar su deseo sexual. Esas historias inventadas son simplemente mentiras comparables a la de los 7 minutos que supuestamente necesitaban las armas iraquíes de destrucción masiva para acabar con Occidente. Hoy en día, las mentiras sobre Irak y Libia sólo dan risa a los pueblos de esos dos países, así como a los de Estados Unidos y Europa (Informe de Amnistía Internacional

La Corte Penal Internacional (CPI)

La CPI (Corte Penal Internacional) emitió en 2011 una orden de arresto contra Muammar el-Kadhafi, Saif al-Islam Kadhafi y Abdullah Senussi, acusados de crimen contra la humanidad. A pesar de la gravedad del crimen, la CPI no hizo ningún tipo de investigación en el terreno sino que elaboró sus conclusiones e identificó a los autores en sólo 2 semanas, a contar desde el momento en que el Consejo de Seguridad de la ONU, puso el caso en sus manos. Nunca se presentó el calendario concedido al fiscal, quien de todas maneras no tenía el tiempo necesario para precisar las penas a las que se exponían los supuestos culpables. El coordinador du Consejo Nacional de Transición libio con la CPI, Ahmed al-Jehani, declaró al respecto que «el caso CPI vs Libia es puramente político ya que los miembros de la OTAN pidieron al Consejo Nacional de Transición (CNT) que hiciera él mismo la lista de funcionarios que serían acusados de crímenes contra la humanidad». El CNT designó a Al-Jehani para preparar esa lista, con una decena de nombres, pero la CPI aceptó sólo 3. Al-Jehani agregó además que todas las acusaciones eran fabricadas y reafirmó su punto de vista durante un encuentro con Saif al-Islam, asegurándole a este último que la justicia libia no podría declararlo culpable. Al-Jehani agregó que, con su equipo, él mismo había fabricado todo ese caso porque sabían que era un caso perdido de antemano y que siguieron adelante para implicar a Saif al-Islam en escándalos financieros y de corrupción.

Al-Jehani justificó sus inventos y mentiras afirmando que son [desde el punto de vista religioso] lícitos durante las guerras (declaración de Al-Jehani documentada el 1º de enero de 2012 y ante el tribunal de Zintan).

La CPI adoptó un doble rasero sobre la guerra contra Libia y la intervención de la OTAN. Implicó a personalidades políticas libias en crímenes inventados mientras que ignoró y no condenó el bárbaro linchamiento perpetrado contra Muammar el-Kadhafi  y contra su hijo Moatassem por las milicias que la OTAN respaldaba. Después del linchamiento, la única reacción de la CPI fue abandonar las acciones legales contra Muammar el-Kadhafi. Sin embargo, la CPI tenía en este último caso [el linchamiento] algo muy sólido ya que los medios de difusión habían documentado bien el asesinato, la CPI no necesitaba ninguna prueba adicional para poder llevar los responsables a los tribunales. La CPI podría fácilmente arrestar a los autores, que desempeñan responsabilidades políticas y diplomáticas en varias capitales europeas. La CPI asumió una posición similar contra Abdullah Senussi, después de que el [nuevo] gobierno libio lo secuestrara en Mauritania. La CPI se limitó a dejar de exigir su extradición. Ni siquiera dio seguimiento a la violación de los derechos de Senussi ni al trato inhumano que sufrió en la cárcel de la milicia, a pesar de que lo habían detenido elementos, bien conocidos como yihadistas, del Grupo Islámico Combatiente Libio (GICL). The International Criminal Court (ICC)

The ICC (International Criminal Court) issued an arrest warrant in 2011 against Muammar el-Kadhafi, Saif al-Islam Kadhafi and Abdullah Senussi, accused of crimes against humanity. Despite the seriousness of the crime, the ICC did not conduct any investigation on the ground, but drew up its conclusions and identified the perpetrators in just two weeks, starting from the moment the UN Security Council put the case in your hands. The calendar granted to the prosecutor was never presented, who did not have the necessary time to specify the penalties to which the alleged guilty parties were exposed. The coordinator of the Libyan National Transitional Council with the ICC, Ahmed al-Jehani, stated in this regard that "the CPI vs. Libya case is purely political as the members of NATO asked the National Transitional Council (CNT) to do it himself the list of officials who would be accused of crimes against humanity ». Al-Jehani justified his inventions and lies by claiming that they are [from the religious point of view] lawful during the wars (statement of Al-Jehani documented on January 1, 2012 and before the Zintan court).

The ICC adopted a double standard on the war against Libya and the intervention of NATO. He implicated Libyan political figures in fabricated crimes while ignoring and not condemning the barbaric lynching perpetrated against Muammar el-Kadhafi and his son Moatassem by the militias that NATO supported. After the lynching, the only reaction of the ICC was to abandon the legal actions against Muammar el-Kadhafi. However, the ICC had in the latter case [the lynching] something very solid since the media had well documented the murder, the ICC did not need any additional evidence to bring the perpetrators to court. The ICC could easily arrest the perpetrators, who carry out political and diplomatic responsibilities in several European capitals. The ICC took a similar position against Abdullah Senussi, after the [new] Libyan government kidnapped him in Mauritania. The ICC simply stopped demanding extradition. He did not even follow up on the violation of Senussi's rights or the inhuman treatment he suffered in the militia prison, despite the fact that he had been arrested by members, well-known as jihadists, of the Libyan Islamic Fighting Group (GICL).
